Structural Reserve Integrity Law Update

Mitchell H. Frumkin, PE, RS is the Founder of Kipcon Inc., a full-service engineering firm that specializes in providing engineering consulting services to community associations.

On a national level, he has served as the President of the Community Associations Institute (CAI) as well as the President of the Foundation for Community Association Research. Locally, Mitchell has held the position of President of both the New Jersey and Keystone (Pennsylvania) chapters of CAI.

In response to the tragic collapse of Champlain Towers South in Surfside, Florida, in June 2021, CAI formed a national task force with the goal of developing public policies to prevent such tragedies. Mitch cochaired this task force, leading to the publication of the Condominium Safety Public Policy Report: Reserve Studies and Funding, Maintenance, and Structural Integrity in October 2021.

In 2023, he chaired the Task Force responsible for updating this public policy, resulting in crucial updates and changes.

Mitch, who Chaired the national Task Force which initially developed the national Reserve Study Standards also played a vital role in enhancing these standards to incorporate structural integrity and maintenance by co-chairing the task force responsible for this endeavor. Furthermore, as a consequence of the Condominium Safety Public Policy, CAI issued a Best Practices Report on Maintenance, with Mitch serving on the task force responsible for its development.

In his capacity as a member of the NJ Community Associations Institute Legislative Action Committee (NJLAC), Mitch contributed to the development and eventual approval of Structural Integrity and Reserve Study legislation in New Jersey (S2760/A4384) which is based on the Public Policy Report on Condominium Safety.

He has also served as co-chair of a task force in New Castle, Delaware, where he played a pivotal role in drafting and securing approval for similar building safety legislation that is now in effect. Mitchell is a licensed Professional Engineer in multiple states and proudly holds the Community Associations Institute’s Reserve Specialist (RS™) designation.

David Ramsey serves as Chair of Becker’s New Jersey Community Association Practice Group. He concentrates his practice in community association law, having represented community associations in New Jersey for over 40 years. His experience also includes significant representation of clients in commercial real estate, zoning and planning law. David routinely lectures, and writes for publication, to other attorneys on a national and state basis as well as presenting programs to board members, managers, and other professionals in the community association field.

He has and continues to serve in various leadership positions in the community association industry. In each of his leadership roles David has been a motivating force in connection with the drafting of legislation critical to the community association world. He has served as president of both the Community Associations Institute (CAI), an international organization that trains association board members and others serving the industry and legislatively advocates for community associations, and as the president of the New Jersey Chapter of CAI. Most recently he was involved as the principal draftsman of the New Jersey Structural Integrity and Reserve Law.

David is a fellow of the College of Community Association Law, which recognizes those attorneys who have provided a significant contribution to the development of common interest community law, and also received the prestigious Community Association Institute Don Buck award, which is given to those attorneys who, over the course of their careers, have provided leadership and education to fellow attorneys.

Ed is the President and Owner of INTEGRA Management Corp. located in Mt. Arlington, NJ. INTEGRA is the preeminent common interest realty management company serving all of New Jersey for 40 years.

INTEGRA employs more than 50 professionals providing common interest realty association management services to communities with a portfolio comprising over 15,000 units. Ed regularly serves as a consultant to developers and his company serves as the property and community management resource to national and regional developers.

Ed is a long standing and active member of the Community Associations Institute (CAI) and is a past president of the NJ Chapter and currently serves as the Vice Chair of the NJ Legislative Action Committee. He is a regular lecturer and panelist and has received numerous awards for his service, including recent recognitions of the Jerome M. Fein Distinguished Service Award for NJ and the CAI National Award of Excellence in Government and Public Affairs. He is a member of the NJ Builders Association. For CAI National he served on the Task Force for Building Structural Integrity and Safety and the Task for Reserve Study Standards. For Rutgers CRE he has been a long-standing member of the Advisory Board, serves on the Scholarship Committee, has a named scholarship, and is now serving on the Executive Committee. He co-teaches the Property Management and Real Estate Investment Management course in Newark. His firm has hired several Rutgers interns and has converted many to fulltime placements in the firm.

Ed has a BS degree from Fairleigh Dickinson University and a Masters in Public Administration (MPA) from Fairleigh Dickinson University, graduating with honors. He has attained CAI’s highest educational designation, the Professional Community Association Manager (PCAM). His company is one of only 15 in New Jersey to possess and maintain the CAI Accredited Association Management Company (AAMC) designation.
